Terms and Conditions

1. Scope, acceptance, and related agreements

These Terms and Conditions (“Terms”) are between you and Fuse Labs, an Ontario, Canada sole proprietorship (“Fuse Labs,” “we,” “us,” or “our”). They cover DMGKit 3, its Kit assistant and built-in Reports/Inspector features, CLIKit (including its standalone distribution), the separate DMGKit Inspector menu bar app, dmgkit.app, and related services. “Software” means these software products collectively where the context permits.

Please read these Terms before purchasing or using the Software. You accept them when you expressly agree through a purchase, installation, or in-app acceptance process, or when you use the Software after being given a reasonable opportunity to review them and where that conduct forms an agreement under applicable law. If you do not agree, do not purchase or use the Software. Nothing here removes a cancellation or refund right that already applies.

You must have legal capacity to enter this agreement. If you act for a business or other organization, you must have authority to bind it, and “you” includes that organization. The products are not intended for children under 13; being 13 or older does not by itself establish contractual capacity.

The applicable End User License Agreement (EULA) also governs Software licensing. These Terms address general use, purchases, and services; the EULA addresses specific software-use permissions and restrictions. Read both together. A specific written purchase commitment or separately agreed license controls over a conflicting general provision. Mandatory law and non-excludable rights always prevail. Third-party and open-source terms govern the relevant third-party components and platform services, rather than granting rights in unrelated Fuse Labs code.

Our Privacy Policy explains information handling. Acceptance of these Terms is not blanket consent to optional analytics, unrelated processing, or the disclosure of project contents.

2. Direct DMGKit license and permitted use

For the direct Gumroad version, a valid purchase grants a non-exclusive license to use the purchased version of DMGKit for personal or commercial work within the entitlement offered at purchase, subject to these Terms and the applicable EULA. DMGKit is licensed, not sold. You may create, inspect, sign, notarize, package, and distribute your own or authorized third-party apps, DMGs, and PKGs.

Direct licenses purchased on or after June 12, 2026 permit one activation on one Mac. A separate license is required for each additional Mac on which that direct license is activated or used. Different entitlements expressly agreed in writing or supplied with an earlier purchase remain governed by that offer; these Terms do not retrospectively reduce them. The Setapp version and free CLIKit/Inspector tools are addressed separately below.

You may request a transfer to a replacement Mac that you own and operate, provided use under that license stops on the previous Mac. Contact support if an activation reset is required. We may review or decline a transfer where there is reasonable evidence of license sharing, fraud, excessive transfers, or other misuse, subject to applicable law and your purchased rights.

A direct license is non-transferable to another license holder and non-sublicensable unless we expressly agree otherwise or the law requires otherwise. Commercial use is permitted within the purchased entitlement; it does not make one activation a shared team, agency, classroom, or organization-wide license. Coworkers, contractors, clients, and other users may not share one purchased entitlement beyond its permitted scope.

3. License activation and validation

Direct-version license keys are issued through Gumroad and validated with its license-verification service using the key and product ID. Activation affects Gumroad’s license “uses” count. DMGKit stores the license and activation/install records locally in the macOS Keychain. A valid entitlement is necessary for licensed direct-version functionality; no uninterrupted availability of a third-party validation service is promised.

Keep your license key confidential. You must not share, publish, resell, fraudulently obtain, or use unauthorized keys; evade activation limits; falsify entitlement; or bypass or interfere with licensing controls, except to the extent a particular restriction cannot lawfully be imposed.

Deleting local licensing records does not transfer or erase the purchase. It may deactivate the app and require support before reactivation. A privacy request or refusal of website analytics is not itself license misuse. If you request deletion of records essential to entitlement, we will explain any resulting inability to verify or continue that license before acting. See the Privacy Policy.

4. CLIKit and automated workflows

CLIKit is a free, separate command-line tool available through DMGKit and as a standalone download. Subject to its applicable license and these Terms, it may be used for personal or commercial workflows, including Terminal, SSH, CI, and Xcode post-archive automation. The paid DMGKit direct-license activation requirement does not apply to CLIKit merely because you use that free tool. Free availability does not make Fuse Labs’ proprietary code open source or authorize redistribution of the tool without permission.

Review commands, configuration, input paths, output locations, and generated archive scripts before running them. Automation may sign, change a working copy, submit a complete artifact to Apple, create installers, or replace output files without an interactive review at each step. You are responsible for running it only in authorized accounts, machines, and CI environments, maintaining backups, and checking the final artifacts.

Installation to /usr/local/bin may require authorization through macOS’s own administrator prompt. DMGKit does not see or store that password. CLIKit settings may be imported from DMGKit and stored in ~/.config/clikit/config.json or a project’s clikit.json. Protect project and CI configurations, API-key paths, and any output or logs your environment retains. Removing the installed tool does not automatically remove its configuration.

Interactive Terminal sessions normally check for updates once daily; set CLIKIT_NO_UPDATE_CHECK=1 to disable those automatic checks. Update information and downloads come from dmgkit.app. Apple-service dependencies and the workflow responsibilities below apply equally to CLIKit.

5. DMGKit Inspector and inspection reports

DMGKit Inspector is a separate free menu bar utility and can be used independently of paid DMGKit. The paid direct-version activation limit does not apply merely because you use Inspector. These Terms and any applicable software license govern its use. Its optional “Open at login” function uses the macOS login-item service.

Built-in Reports, standalone Inspector, and CLIKit inspection provide technical information from local macOS tools, including signatures, notarization and stapling status, Gatekeeper results, versions, architectures, entitlements, hashes, and other artifact properties. Inspection may mount a DMG read-only and eject it afterwards. Some trust checks contact Apple.

A trust score, successful inspection, valid signature, notarization ticket, or Gatekeeper result is not a security audit, malware guarantee, legal-compliance certificate, or promise of future Apple acceptance. The score summarizes Apple trust signals available during the checks. Reports can be incomplete or affected by the inspected content, environment, tool behavior, or service availability. They do not establish that an app is safe, that its claimed author is trustworthy, or that its permissions are appropriate.

Apple can change or revoke trust decisions after an inspection. Use additional testing and review appropriate to your release or installation decision. Responsibility for reports and losses remains subject to the consumer protections and liability provisions below.

6. Purchases, platforms, and Setapp

DMGKit is available through Gumroad, Setapp, and our website. The price, currency, applicable tax information, included version/features, and any specific update entitlement are those disclosed in the applicable offer and checkout. These Terms do not create a new subscription or an undisclosed charge.

Gumroad handles direct purchases, payments, and license issuance through its platform. Review the Gumroad Terms of Service and the offer presented to you. Gumroad controls its own billing, payment, dispute, and platform refund processes. Fuse Labs remains responsible for obligations it owes you as the software provider; use of a payment platform does not eliminate those obligations.

The Setapp version uses Setapp entitlement and includes MacPaw’s framework. Subscription access, permitted devices, billing, renewal, cancellation, and platform refunds are governed by your Setapp agreement and the Setapp Terms of Use. The direct Gumroad single-activation rule does not replace your Setapp entitlement. Deleting the app or asking Fuse Labs for support does not itself cancel a Setapp subscription; use Setapp’s cancellation process.

The Setapp framework communicates with Setapp/MacPaw for subscription confirmation and usage reporting associated with revenue sharing. Refer to the Privacy Policy’s Setapp section and Setapp’s notice. A Setapp entitlement does not automatically give you a separate direct-version Gumroad key.

7. Refunds, cancellation, and consumer remedies

For direct purchases, sales are final except where the purchase offer, the applicable platform process, or mandatory law provides otherwise. We may also approve a discretionary refund, particularly if the Software fails to function as described or a verified technical problem cannot be resolved. Contact support@fuselabssoftware.com with the purchase reference and an explanation; do not send signing keys or passwords.

A suspension or revocation for proven license sharing, fraud, circumvention, or other material misuse does not normally qualify for a discretionary refund. This does not remove a statutory refund, cancellation, price-reduction, repair, or other remedy, or override the purchasing platform’s lawful process. A legitimate complaint, payment dispute, or exercise of consumer or privacy rights is not by itself misuse.

For Setapp subscriptions, request cancellation or platform refunds through Setapp under its terms. Where Gumroad handles a refund or transaction dispute, its process also applies. We do not promise a platform refund outcome that is outside our control. These platform arrangements do not displace any duty imposed on Fuse Labs by law.

Consumer rights are preserved. Depending on your location and transaction, these include rights concerning accurate descriptions, acceptable quality, conformity, functionality, updates required by law, cancellation, and remedies for defective digital content. An “as is” statement, revocation clause, or general final-sale rule in these Terms does not exclude them.

Where EU/EEA or UK law gives a consumer a withdrawal period for digital content, beginning a download does not by itself prove a valid waiver. Loss of that right requires the legally required express consent to early supply, acknowledgment, and contract confirmation. Agreeing to general Terms is not a substitute for those steps. The relevant checkout and platform process must comply; if no valid loss of the right occurred, applicable withdrawal rights remain. Rights concerning defective or non-conforming content remain separate from a change-of-mind withdrawal right. See the EU consumer information and UK digital-download guidance.

8. System requirements and compatibility

The Software is designed for macOS. Requirements differ by product, version, architecture, engine, and operation. Check the applicable release information before purchasing or updating. Apple’s on-device Kit engine requires supported Apple Intelligence hardware/software and macOS 26 or later. The optional modern diskutil image workflow is for macOS 27 or later where available, with fallback to the established tool.

Some workflows require appropriate macOS developer tools, signing certificates, accounts, entitlements, network access, available disk space, or third-party services. These are your responsibility unless the offer expressly includes them. An optional local AI model needs download bandwidth, storage, and adequate local resources; it is not promised to perform identically on every Mac.

DMGKit and Inspector compatibility checks aim to offer updates supported by the Mac’s minimum macOS and architecture. They do not guarantee compatibility with every project, dependency, custom entitlement, future macOS release, or external service. This qualification does not excuse a failure to meet a binding product description or mandatory consumer standard.

9. Apple signing, notarization, stapling, and credentials

DMGKit and CLIKit assist with Apple distribution workflows; they do not supply an Apple Developer membership, certificate, account entitlement, or approval. You are responsible for using authorized accounts, valid credentials and certificates, appropriate entitlements, and an artifact you have permission to sign or submit. Comply with the Apple agreements applicable to your account and workflow.

Notarization uploads the full submitted app, DMG, or PKG to Apple using Apple’s notarytool and your credentials. Check the content before submission. DMGKit may prepare a working copy by removing quarantine attributes, fixing permissions, or re-signing. These changes can affect an existing signature, behavior, or distribution configuration. Keep an original copy and inspect the exported result.

Notary Keychain passwords remain in the macOS Keychain. API-key authentication copies the chosen .p8 file to DMGKit’s local NotaryKeys folder with owner-only permissions; Key ID and optional Issuer ID are saved locally. Protect these credentials, limit access to your user account and backups, and revoke or rotate a compromised key through Apple. Removing DMGKit’s copy does not revoke the original key or remove other copies.

Stapling asks Apple for an existing ticket. “Staple Only” does not submit the full artifact again and may not attach a ticket if none is available. Choosing “Off,” proceeding after a warning, or skipping a missing ticket can leave an output without the signing/notarization/stapling properties you expect. Gatekeeper, stapler, and final status checks can involve Apple’s servers.

Apple controls its services, requirements, acceptance, availability, and revocation decisions. Successful export or a status message is not a promise of App Store acceptance, permanent notarization, installation on every Mac, or compatibility with future Apple rules. Review final artifacts and their intended distribution path.

10. DMG/PKG creation and release responsibilities

The Software can create and compress disk images and installer packages using local macOS tools. PKGs can be signed with your Developer ID Installer certificate, notarized, stapled, and supplied with legal-document pages. Available formats and tools depend on the version and configuration.

You are responsible for the apps, files, resources, legal notices, licenses, permissions, package installation behavior, target locations, and other content you include. Ensure you have the right to distribute each item and that installation, mounting, updating, uninstallation, and permission behavior are suitable for the intended users.

Test the actual exported artifact, including signatures, entitlements, executable behavior, DMG layout, installer contents, installation effects, and legal text. Do not treat an export success, progress indicator, or final check as complete release validation. Keep backups before operations that modify files or create/replace outputs.

Fuse Labs does not become the publisher, author, operator, or end-user support provider of your app merely because you package or inspect it with the Software. We do not claim ownership of your app or require your customers to buy DMGKit to open a standard output artifact.

11. Kit assistant and optional local models

Kit is an on-device assistant for DMGKit and related distribution tasks. It can process the current session log, open inspection report, conversation, and locally saved custom instructions to explain results and help diagnose failures. It uses either Apple’s supported on-device model or the optional Qwen3-4B-Instruct-2507 model run locally through llama.cpp. Downloading Qwen from Hugging Face is optional and initiated by you; its separate model terms and the runtime’s applicable open-source notices apply.

Kit’s answers are AI-generated and may be incorrect, incomplete, outdated, or inappropriate for your project. They are informational assistance, not a security audit, a professional opinion, or legal advice. Independently verify suggested commands, signing changes, entitlements, release decisions, and legal statements before relying on them. No answer constitutes a warranty or a promise that Apple will accept an artifact.

Kit does not send questions, answers, session logs, or inspection content to Fuse Labs or an external AI service. The optional model download still involves a network request to Hugging Face. Kit chats and DMGKit session logs are memory-only and disappear when DMGKit quits; custom instructions persist locally. Do not rely on a conversation as your only copy of important information.

Session-log redaction removes specified secrets before Kit sees that log, but it is not a promise to identify every possible secret in material you enter yourself. Do not paste credentials into chat, custom instructions, or support messages. The Privacy Policy explains the separate local and network flows.

12. Designer, templates, and your content

Designer content, text layers, backgrounds, icon labels, images, stickers, and templates are processed locally. Templates can embed media you add. You are responsible for the rights to fonts, artwork, trademarks, text, and other resources you include and for any license notices required when you distribute them.

You retain the rights you have in your own content and exported artifacts. These Terms do not transfer that ownership to Fuse Labs. They also do not grant you ownership of our software, branding, bundled assets, or third-party resources. Any rights to such materials are limited to the license supplied with them.

Review templates and generated layouts before release. If you save to a synchronized location or share a template, the chosen service or recipient may receive its embedded content. That is separate from DMGKit’s local processing.

13. Legal editor, translation, and installer notices

The legal editor can store and add your Terms, Privacy Policy, and EULA to a DMG license agreement or PKG license page, including multiple languages. Translation uses Apple’s on-device Translation framework; macOS may download language packs from Apple.

Editing, translating, or displaying a document does not make it legally sufficient or enforceable. The Software does not supply legal advice, determine the law applicable to your customers, verify that you own necessary rights, or establish that users validly accepted a contract. Automated translations may omit, change, or mistranslate legally significant language.

You are responsible for reviewing the source and every translated version, selecting any controlling language where legally permitted, obtaining suitable legal advice, and implementing the notices, consent, and acceptance process your distribution requires. Review the actual DMG/PKG display, character rendering, language selection, and user flow; an injected license page is not a substitute for a legally required pre-purchase disclosure or consent.

14. Sparkle appcast generation and signing keys

DMGKit can run Sparkle’s local generate_appcast tool after export using saved app profiles and your Sparkle signing keys in the macOS Keychain. You are responsible for selecting the correct profile, release metadata, feed URL, payload, and signing key and for testing updates in your own application.

Generation does not itself publish an appcast or provide hosting, a release channel, or an update-delivery guarantee. Protect and back up your signing keys securely. Losing a key used for a shipped app may prevent future updates from being signed for its existing public key; changing it requires an appropriate migration under Sparkle’s documentation.

Sparkle’s component terms and notices apply. This workflow is separate from DMGKit’s own GitHub Gist version checks and does not imply that Fuse Labs hosts or operates your update service.

15. Updates, availability, and support

Update entitlement is determined by the offer applicable to your purchase or distribution channel. We do not promise lifetime updates, every future major version, a particular support response time, or an uninterrupted service unless expressly stated in a binding offer or required by law.

DMGKit and Inspector use GitHub Gist version feeds; CLIKit uses the update information and downloads hosted on dmgkit.app. GitHub Gists provide version information, not customer license lists. Automatic DMGKit checks can be disabled in Settings; CLIKit’s opt-out is explained above. The Setapp framework and platform also operate according to their own update and entitlement arrangements.

We may release fixes, change features, or discontinue versions or services for technical, security, business, or legal reasons, subject to purchased commitments, required notice, and mandatory remedies. These Terms do not authorize us to remove an essential paid feature retroactively without regard to those obligations. Any update required by consumer law remains subject to that law.

You are responsible for reviewing updates and maintaining appropriate backups. Contact support for product problems; do not share credentials. We cannot guarantee resolution of a problem caused by an unsupported environment or a service outside our control, but this does not remove an applicable legal remedy.

16. Privacy, local settings, and notifications

The Privacy Policy describes local files and settings, ephemeral sessions, third-party requests, purchase records, support submissions, retention, and removal controls. No fixed retention schedule for Fuse Labs’ customer records is created by these Terms.

The apps do not contain Fuse Labs analytics, tracking, or crash-reporting SDKs or send app usage data to the developer. The Setapp framework’s subscription/usage reporting is a separate disclosed exception. Google Analytics on dmgkit.app operates only after analytics acceptance. Refusing that optional analytics is not a breach of these Terms.

First-launch choices, EULA acceptance state, intro-version state, window position, and other preferences are stored locally. Optional local macOS notifications can show filenames and results; use macOS controls if that information should not appear on screen. Removing an app does not automatically remove every preference, model, copied key, configuration, or Keychain item.

17. Intellectual property and third-party components

Fuse Labs and its licensors retain their respective rights in the Software, documentation, branding, and other protected materials. Except for rights expressly granted, no intellectual-property license is implied. Do not remove or obscure ownership or licensing notices.

Apple frameworks and tools, Qwen model weights, llama.cpp, Sparkle, the Setapp framework, and other third-party components are governed by their respective applicable terms and notices. The availability of a model download does not grant rights beyond its accompanying license. Where an open-source or third-party license permits conduct that these general restrictions would otherwise prohibit, that license controls for the relevant component.

Except as permitted by applicable law, an applicable component license, or our written permission, you may not resell, redistribute, sublicense, modify, or create derivative versions of Fuse Labs’ proprietary Software, or reverse engineer, decompile, or extract its source code. Nothing here restricts non-waivable interoperability, research, or other statutory rights.

18. Acceptable use and export compliance

Use the Software only where you have authorization to access, inspect, modify, sign, or distribute the relevant content. You must not use it to facilitate unlawful activity, distribute malicious software, forge another party’s signing identity or endorsement, steal credentials, infringe others’ rights, or interfere with a service or another person’s systems.

Do not defeat licensing controls or distribute unauthorized copies of the Software. This restriction does not prevent conduct expressly permitted by applicable law or a component’s open-source license. Inspection of a file you are lawfully entitled to inspect is not prohibited merely because a third party authored it.

Comply with export controls, sanctions, and import rules that actually apply to you, the Software, model files, cryptographic tools, and your distributed artifacts. Do not export, re-export, or use them in a transaction prohibited by applicable law. These Terms do not assert that every country or every user is subject to the same restrictions.

19. Suspension, termination, and license cancellation

We may suspend, deactivate, or terminate an affected license or service for material breach, license sharing, circumvention, fraud, unlawful use, or another legally sufficient reason. We may also cancel a license at the holder’s request. Setapp subscription actions remain subject to Setapp’s authority and process; these Terms do not give Fuse Labs control over your entire Setapp account.

Where reasonably practicable and appropriate, we will explain the basis and give an opportunity to respond or correct a remediable breach. Immediate action may be appropriate for fraud, a security risk, serious misuse, or a legal requirement. Contact support if you believe an action was mistaken. Enforcement must remain consistent with applicable law, purchased rights, and any mandatory remedy.

When a particular Software license lawfully ends, stop using that Software under the terminated entitlement and remove unauthorized copies. This does not automatically terminate a separate valid license, erase your ownership of your content, or revoke rights already granted to recipients of your own lawful output artifacts. The intellectual-property, accrued payment, dispute, and other provisions that by their nature need to survive continue to the extent lawful.

Termination for misuse does not create a discretionary refund entitlement. It does not eliminate a non-excludable refund or other consumer right. License cancellation and deletion of personal information are distinct processes; see the Privacy Policy for records that must or may lawfully remain.

20. Warranties and statutory protections

Except for express commitments made in the applicable offer and warranties that cannot lawfully be excluded, the Software and informational outputs are provided “as is” and “as available.” To the extent permitted by law, we disclaim implied warranties and conditions, including merchantability, fitness for a particular purpose, and non-infringement.

We do not promise uninterrupted or error-free operation, detection of every defect, compatibility with every environment, an accurate AI answer or translation in every case, or successful signing, notarization, installation, or distribution regardless of configuration and external services.

These qualifications do not override an express product description, a legally binding promise, or mandatory consumer guarantees. Consumers may have rights to quality, conformity, repair, replacement, price reduction, refund, or compensation that apply despite this section. The free status of a tool does not exclude a duty that the law imposes.

21. Liability and distribution risk

To the extent permitted by law, Fuse Labs is not liable for indirect, incidental, special, or consequential losses arising from the Software or related services, including such losses involving profits, revenue, business opportunity, release delays, or lost data. Whether a particular loss can lawfully be excluded depends on the applicable law and circumstances.

You are responsible for the content and release decisions of your own software and installers. To the extent permitted by law, Fuse Labs is not liable for failures caused by your unauthorized content, incorrect credentials or configuration, unreviewed AI suggestions, or independent third-party service failures. These qualifications do not exclude responsibility that the law places on us for our own conduct.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such liability cannot be excluded, or any other liability or consumer remedy that cannot lawfully be limited. No clause requires you to surrender a non-waivable statutory claim. The exclusions apply only to the extent valid in your jurisdiction and are not a blanket exclusion of every kind of damage.

22. Business-user indemnity

If you use the Software in the course of business, and to the extent permitted by law, you will indemnify Fuse Labs for third-party claims and reasonable, documented associated losses and defense costs arising from your unlawful distribution of content you lack rights to distribute, your deliberate misuse of credentials or signing identities, or your material breach of these Terms. This does not cover a claim to the extent caused by Fuse Labs’ own breach, negligence, fraud, or unlawful conduct.

We will provide reasonably prompt notice of a covered claim and reasonable cooperation. You may not agree to a settlement that admits liability or imposes an obligation on Fuse Labs without our consent, which will not be unreasonably withheld. This contractual indemnity is not imposed on an individual acting solely as a consumer.

23. Third-party services and outages

Operations may depend on Apple, Gumroad, Setapp/MacPaw, GitHub, Hugging Face, Namecheap hosting, Google website analytics, and other components identified in the Privacy Policy or applicable notices. Your interaction with an independent platform is subject to its applicable terms. Review the relevant service requirements before use.

We do not control independent providers’ availability, approval decisions, prices, account eligibility, policies, or APIs. A provider change may prevent a dependent workflow from completing. Platform terms govern that provider’s own service; they do not replace Fuse Labs’ obligations or mandatory rights concerning our Software.

For EU/UK customers, purchase-platform terms and privacy notices explain the platform’s own contract, billing, and data handling. They do not operate as a general exemption for Fuse Labs from EU/UK consumer or privacy law. No third-party arbitration or waiver is imported into your agreement with Fuse Labs merely by linking to platform terms.

24. Governing law and disputes

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, subject to mandatory protections that apply to you. If you are a consumer, this choice does not deprive you of rights under mandatory laws of your habitual residence where those laws apply, including applicable EU/EEA or UK consumer protections.

Contact support@fuselabssoftware.com to help resolve a dispute. Contacting support is not a condition that removes a statutory complaint, court, chargeback, or other mandatory remedy. These Terms do not require arbitration or waive class-action rights. A competent court may hear a dispute; nothing here prevents a consumer from using a forum available under mandatory law.

25. Changes and general provisions

We may update these Terms for changes in the products, services, or law. The date above identifies this version. We will provide appropriate notice of material changes and obtain acceptance where required. A website edit alone does not retrospectively change an already completed purchase or remove a vested entitlement. Continued use constitutes acceptance only where legally valid after proper notice and an opportunity to review the change.

If a provision is unenforceable, it will apply only to the extent lawful or be severed if necessary, without removing the rest of the agreement where it can validly continue. Failure to enforce a provision on one occasion is not a general waiver. These Terms, the applicable EULA, and specific purchase commitments comprise the relevant agreement; they do not exclude liability for a binding representation or a non-waivable pre-contract disclosure.

You can save or print this page for reference. Any legally required contract copy, pre-purchase disclosure, or consent must also be supplied through the applicable transaction process; publication of this page alone does not establish that those requirements were met.

26. Contact Fuse Labs
